411.0725 — Order of Nondisclosure (Deferred Adjudication — Misdemeanors & Felonies)

This guide is for you if:

• You finished deferred on an eligible misdemeanor or certain felonies (411.0725)
• You were discharged and the case was dismissed
• You stayed out of trouble during deferred and the wait time
• You meet the waiting rule: some are immediate, some 2 years, some 5 years
• No disqualifying offenses

411.0726 — Order of Nondisclosure (Certain DWI/BWI Deferred Adjudication Cases)

This guide is for you if:

• You finished deferred adjudication for a first time DWI or BWI (411.0726)
• You were discharged and the case was dismissed
• Your BAC was under 0.15
• No crash involving another person, including no injury or death
• You wait 2 years after discharge and dismissal before you file

• You successfully completed Veterans Treatment Court (411.0727)
• You want to seal the offense that sent you into the program
• You waited at least 2 years after completing the program before filing
• You stayed out of trouble during that 2-year waiting period
• You meet the general nondisclosure rules and have no disqualifyin

• You are a trafficking survivor and the offense happened because you were trafficked
• The offense is a qualifying low level offense under 411.0728
• You finished the case (conviction or deferred)
